Press Release: Updates From The Court Of Appeal On The SDP Presidential Candidacy Litigation 

Proceedings at the Court of Appeal sitting in Abuja Division today in the Case between, the SDP and four (4) others (Appellants) Vrs Professor Jerry Gana and INEC (Respondents) are as below:
1.The Appelants(SDP and 4 others) adopted their brief of argument and all other processes before the learned trial Justices of the Court of Appeal.
2. The Respondents (PJG and INEC) adopted their response to the brief of argument. The Respondents also adopted all other processes before the Court.
3. The Motion for stay of execution earlier filed by the Appellants was withdrawn. That means the stay of execution is no longer necessary because of the timing of election and given the fact that judgement in the main suit is already reserved. So taking the Motion for Stay of Execution of the Abuja High Court judgement would amount to waste of time, since the main motion before the Honourable Court is almost determined.
4. The Respondents also withdrew their Counter Affidavit, which was in opposition to the Motion for Stay of Execution of the Abuja High Court judgement.
5. The Court Reserve the judgement. Which means, the date for the judgement will be communicated to both parties in due course.
Present in court today were both parties, their lead legal counsels, supporters and journalists.
