    National Guard Disputes Walz’s Military Bio

    Media Calls Out ‘Absolutely False’ Claim Over Deployment

    The Minnesota National Guard has disputed Governor Tim Walz’s military biography, saying that his claims of retiring at the rank of command sergeant major is untrue.

    Minnesota National Guard spox Army Lieutenant Colonel Kristen Augé told Just the News that Walz, Kamala Harris’ vice presidential running mate, was demoted and did not retire as a command sergeant major as he has claimed for years – including on his official gubernatorial biography – as he failed to complete a 750-hour course in the Army’s Sergeants Major Academy, a mandatory course for E-9s, the Army’s highest enlisted rank.

    While Walz temporarily held the title of command sergeant major he “retired as a master sergeant in 2005 for benefit purposes because he did not complete additional coursework at the U.S. Army Sergeants Major Academy,” Army Lt. Col. Kristen Augé, the Minnesota National Guard’s State Public Affairs Officer, told Just the News.

    The statement reignited a controversy that began during his 2018 election for governor in which National Guardsman claimed on social media and in a paid ad that Walz declined to deploy to Iraq for combat duty in 2005 and forfeited his title of command sergeant major. Walz chose to run for Congress that year. -Just the News

    The governor’s biography, however, says that “Command Sergeant Major Walz” retired from the Minnesota National Guard in 2005. At the time he was serving as one of the highest ranking members of the 1-125th Field Artillery Battalion.

    “He retired as a master sergeant in 2005 for benefit purposes because he did not complete additional coursework at the U.S. Army Sergeants Major Academy,” said Augé.

    That said, an unnamed Guard spokesperson told Task & Purpose, in direct contradiction to Augé, that Walz’s demotion was a technicality.

    “Soldiers who do not finish the course revert back to their prior rank,” they told the outlet. “This is what we refer to as an administrative reduction and not punitive in nature.”

    The outlet also claims that the Guard ‘confirmed’ that Walz was properly promoted and served in the E-9 role, and “retired as” an E-9, despite the later reduction.

    That said, Task & Purpose also framed the entire stolen valor controversy as “The ‘Swift Boating’ of Tim Walz” – as if his on-record lies about ‘weapon of war, that I carried in war’ (he never saw war), are the same as disputed allegations over John Kerry’s (D) Vietnam war record.

    On Wednesday we noted that Walz straight up lied about having been deployed in a combat zone.

    The lies were so egregious that even CNN acknowledged they were less than ideal.

    “Walz did make a comment speaking to a group, he’s done it a couple of times, where he has used language that has suggested that he carried weapons in a fighting situation,” said CNN correspondent Tom Foreman in a fact check. “As you know, with your contact with the military, I know from coming from a military family, there is a difference between being in a combat area, being involved at a time of war and actually being in a position where people are shooting at you. There is no evidence that at any time Governor Walz was in a position of being shot at, and some of his language could easily be seen to suggest that he was.”

    So that is absolutely false when he said that about gun rights out there. The campaign has essentially come forward to say, ‘Look, he had a long career, he would never want to purposely mislead people about this.’ It’s what campaigns tend to say,” Foreman continued.

    Meanwhile, in a 2006 press release issued by his campaign, Walz is described as a “veteran of Operation Enduring Freedom,” the US military operation in Afghanistan. As modernity.news notes, some have charged that this is misleading given that Walz was stationed in Italy at the time, with his battalion providing base security in Europe.

    Walz has also come under fire from the men he served with, who they described in a 2019 letter as ‘Traitorous, fraudulent and shameful.’

    Meanwhile, the Free Beacon reports that Walz knew his National Guard battalion was being eyed for a likely redeployment to Iraq when he decided to retire.

    “As Command Sergeant Major, I have a responsibility not only to ready my battalion for Iraq, but also to serve if called on,” Walz said in a campaign statement on March 20, 2005. Just three days prior, the National Guard Public Affairs Office announced that at least part of his battalion could be shipped overseas to the Middle East in the next two years.

    Walz left the National Guard that May. Two months later, his battalion was put on notice that they would be deploying to Iraq.

    When questioned about all of it, Walz decided to duck, cover, and run from a journalist before an explanation could be ‘deployed.’

  • Judicial Watch: Federal Judge Orders Biden Justice Department to Answer Ashli Babbitt $30 Million Wrongful Death Lawsuit

    (Washington, DC) – Judicial Watch announced today that following a hearing on August 6, Judge Ana C. Reyes of the U.S. District Court for the District of Columbia ordered the U.S. Department of Justice to answer the $30 million wrongful death suit filed on behalf of the estate of Ashli Babbitt, who was killed in the U.S. Capitol on January 6, 2021, by then-Capitol Police Lt. Michael Byrd. The court gave the government 30 days, until September 6, to answer the complaint. The order also states that Judicial Watch can file a reply brief by August 23 in its petition to have the case returned to Babbitt’s home of San Diego where it was originally filed: 

    Minute Entry for proceedings held before Judge Ana C. Reyes: Pre-motion Conference held on 8/6/2024 via Zoom. For the reasons stated on the record, Plaintiff may file a reply brief by 8/23/24. Defendant to file a partial answer as to counts 1,2,6 and 7 by 9/6/2024. Rule 26 to be filed by 9/13/2024. Status Conference set for 9/20/2024 at 03:00 PM in Telephonic/VTC before Judge Ana C. Reyes.

    Babbitt, 35, owned and operated a successful pool business with her husband Aaron. Ashli traveled alone from San Diego to Washington, DC, to attend the Women for America First (aka Save America) rally on January 6, 2021, at the Ellipse. 

    The wrongful death lawsuit was filed on January 5, 2024, in the U.S. District Court for the Southern District of California against the U.S. Government on behalf of the family of Ashli Babbitt, the U.S. Air Force veteran who was shot and killed inside the U.S. Capitol by then-Capitol Police Lt. Michael Byrd on January 6, 2021 (Estate of Ashli Babbitt and Aaron Babbitt, et al. v. United States of America (No. 3:24-cv-00033)).

    The Justice Department must respond to the lawsuit’s claims for wrongful death, assault and battery, negligence and a claim for “survival action” under federal law. (As a result of the court’s order, the lawsuit will proceed on these key counts, as the court considers the Biden administration’s request to dismiss certain other claims.)

    The Judicial Watch complaint recounts:

    The shooting occurred at the east entrance to the Speaker’s Lobby. After demonstrators filled the hallway outside the lobby, two individuals in the crowded, tightly packed hallway struck and dislodged the glass panels in the lobby doors and the right door sidelight. Lt. Byrd, who is a United States Capitol Police commander and was the incident commander for the House on January 6, 2021, shot Ashli on sight as she raised herself up into the opening of the right door sidelight. Lt. Byrd later confessed that he shot Ashli before seeing her hands or assessing her intentions or even identifying her as female. Ashli was unarmed. Her hands were up in the air, empty, and in plain view of Lt. Byrd and other officers in the lobby.

    The lawsuit points out that, based on prior incidents involving Lt. Byrd, the Capitol Police, Capitol Police Board, and ultimately Congress, as Lt. Byrd’s employer, “knew or should have known that Lt. Byrd was prone to behave in a dangerous or otherwise incompetent manner.”

    The next hearing is set for September 20.

    “Ashli Babbitt’s family is thrilled the $30 million wrongful death lawsuit for her outrageous killing is moving full speed ahead,” Judicial Watch President Tom Fitton said.

     In April 2024, records from the U.S. Department of Justice (DOJ) in a separate Freedom of Information Act (FOIA) lawsuit showed that the FBI opened a criminal investigation of Air Force veteran Ashli Babbitt after her killing and listed four “potential violations of federal law,” including felony rioting and civil disorder.

    In September 2023, Judicial Watch received records from the Executive Office for United States Attorneys, a component of the Department of Justice, in a FOIA lawsuit that detail the extensive apparatus the Biden Justice Department set up to investigate and prosecute January 6 protestors.

    A previous review of records from that lawsuit highlighted the prosecution declination memorandum justifying the decision not to prosecute U.S. Capitol Police Lt. Michael Byrd for the shooting death of Babbitt.

    In January 2023, documents from the Department of the Air Force, Joint Base Andrews, MD, showed U.S. Capitol Police Lieutenant Michael Byrd was housed at taxpayer expense at Joint Base Andrews after he shot and killed U.S. Air Force veteran Ashli Babbitt inside the U.S. Capitol on January 6, 2021. 

    In November 2021, Judicial Watch released multiple audio, visual and photo records from the DC Metropolitan Police Department about the shooting death of Babbitt on January 6, 2021, in the U.S. Capitol Building. The records included a cell phone video of the shooting and an audio of a brief police interview of the shooter, Byrd.

  • Fact Check: Claims Elon Musk called to ban ‘The View’ originated on a satire site

    What has higher viewership ratings — ABC’s “The View” or misinformation about entrepreneur Elon Musk calling to end the daytime talk show?

    We’ve previously fact-checked and found false claims that Musk acquired ABC and fired the show’s hosts, and that he sued the show and co-host Whoopi Goldberg.

    Now circulating on social media: purported “breaking” news that “Musk calls for ban on ‘The View’” and said, “I’d rather walk barefoot on hot asphalt than watch ‘The View.’”

    A July 27 Facebook post sharing the claim was flagged as part of Meta’s efforts to combat false news and misinformation on its News Feed. (Read more about our partnership with Meta, which owns Facebook and Instagram.)

    We found no evidence, such as credible news reports or public statements from Musk or “The View,” that he is seeking to ban the show from television. 

    We did find a May blog post making the exact claim, only with a caveat: It’s satire. 

    The blog describes itself as a source of “fake news stories.”

    We rate social media posts that ripped the satire blog out of context False.

    Nigel Farage accused the Labour Party of trying to blame the anti-mass migration riots on him out of fear of losing votes to his Reform UK party in left-behind areas of the country.

    Mr Farage said that it was “despicable” for legacy media and political establishment in Westminster to cast blame on him for the riots that swept the nation in the wake of a mass stabbing at a children’s dance party allegedly by a Rwandan-heritage teen in Southport last week.

    The Brexit leader told Sky News on Tuesday the reason there have been attempts to blame him for the violent uprising was that the Labour Party is “terrified that many of their own voters will vote for me”.

    While the press and politicians have branded the riots as entirely “far-right”, the violence has almost exclusively occurred in traditional Labour Party-supporting cities and towns, including many in the North and Midlands, which have born much of the brunt of mass migration while suffering from de-industrialisation.

    The so-called “Red Wall”, once thought of as unassailably Labour, has increasingly become up for grabs electorally with the region in large part backing Brexit as well as Boris Johnson’s Tories in 2019, at the urging of Mr Farage. In last month’s election, Sir Keir Starmer’s Labour Party won back most Red Wall seats, however, Farage’s Reform leapfrogged the Conservatives and came in second in 98 of these seats behind Labour.

    In a video posted on Youtube, the Reform boss warned that with Sir Keir Starmer branding the entire unrest in the Labour heartland as “far-right”, it will only convince more people to back reform in the Red Wall, saying: “If you use that term far right you’re using it against your own voters and a majority of the population.”

    Farage said that the prime minister has “completely” misread the situation, saying that while placing all the focus of the response on the far-right, it ignores the “general feeling of dissatisfaction” growing throughout the country about “societal breakdown” amid mass migration and economic deprivation.

    This anger, Farage argued, has only been compounded by a growing sense of two-tiered policing in the country…

  • Man arrested a year after Detroit neurosurgeon was found dead, wrapped in carpet in attic

    DETROIT (TCN) — The Wayne County prosecutor announced several charges against a man she alleges fatally shot a successful neurosurgeon, left his body in the attic, and spent thousands of dollars using the victim’s credit cards.

    According to prosecutor Kym Worthy, on April 22, 2023, a resident called the Detroit Police Department to report a white Range Rover was blocking their driveway on Coyle Street. Officers responded to the scene and saw what looked like blood inside the car. They towed the Range Rover and learned it belonged to Dr. Devon Hoover. Police went to Hoover’s home and saw that the gate leading to his house on Boston Boulevard was “wide open.” Officers knocked on the front and back doors, but no one answered.

    The next day, Detroit Police received a call from Hoover’s family asking them to conduct a welfare check because he never showed up in Indiana to visit his dying mother. Officers returned to Hoover’s house and once again saw the gate was open. They reportedly noticed blood on the rear exterior door, so officers made the decision to force entry. Officers did a sweep of the residence and found Hoover face-down in an attic crawl space with a gunshot wound to the head. He was reportedly wearing only a pair of socks.

    The medical examiner confirmed Hoover died from two gunshot wounds to the head and ruled his manner of death a homicide.

    Additionally, Hoover’s wallet, phone, credit cards, and designer watches were missing from his house. Worthy said transactions were made on his cards “almost immediately” after the discovery. Detectives searched his phone records and saw he had 4,000 communications with a man named Desmond Burks. According to Worthy, text messages showed the two men had an intimate relationship, and Burks sometimes charged Hoover for sex.

    Worthy said the investigation took a long time because several witnesses were “reluctant to come forward to share sensitive and personal information.”

    Data reportedly showed Hoover’s cellphone traveled from his address on Boston Boulevard to Burks’ home. Later, the phone was tracked to Hoover’s house again and then back to Burks’. The prosecutor’s office said there were “numerous pieces of corroborating evidence” that placed Hoover’s phone and Burks in the same places.

    On April 22, 2023, video surveillance allegedly showed a man parking Hoover’s SUV on Coyle Street, then limping away. Burks reportedly walks with a limp because he was previously shot in the hip. His fingerprint was also found in the car. Investigators reportedly discovered two of Hoover’s Cartier watches at addresses associated with Burks, including one watch he bought the day before he was killed.

    Worthy said the investigation spanned five states and three countries. Detectives gathered several terabytes of data and collected over 300 pieces of evidence.

    Burks was arrested Aug. 7 on charges of first-degree premeditated murder, felony murder, larceny of $20,000 or more, using a computer to commit a crime, felon in possession of a firearm, and three counts of felony firearm.

    Burks is also facing second-degree murder charges for allegedly killing a 67-year-old man during a road rage incident in April. According to the prosecutor’s office, on April 17 at 6:45 p.m., Reda Saleh’s car allegedly bumped into Burks’ vehicle. They both exited their cars and got into a verbal altercation. Burks allegedly punched Saleh, causing him to fall. Burks allegedly fled while Saleh was still on the ground. Paramedics arrived and took him to a hospital. He died from his injuries on May 11.

    Worthy said Burks was ordered in May to undergo a competency review.

  • Fact Check: Trump said that Gov. Tim Walz didn’t call in the National Guard in 2020. Walz’s order shows he did.

    Former President Donald Trump said during a recent Minnesota rally that it was he — not Gov. Tim Walz — who ordered the National Guard to respond to Minneapolis riots in 2020.

    “Every voter in Minnesota needs to know that when the violent mobs of anarchists and looters and Marxists came to burn down Minneapolis four years ago, remember me?” Trump said at his July 27 St. Cloud rally. “I couldn’t get your governor to act. He’s supposed to call in the National Guard or the Army and he didn’t do it. I couldn’t get your governor. So, I sent in the National Guard to save Minneapolis.”

    CNN and WCCO-TV News, a CBS affiliate in Minnesota, debunked a similar Trump statement in 2020. We found that Walz called in the National Guard hours before Trump contacted him, but Walz has faced criticism about his response’s timing.

    Walz sent in the National Guard

    George Floyd was murdered by a Minneapolis police officer on May 25, 2020. Protests — some peaceful and some violent — erupted soon after video of his death went viral.

    The Harris-Walz campaign did not respond on the record to our request for information. Walz’s governor’s office also did not respond to PolitiFact’s email asking about Trump’s claim. However, Walz spokesperson Teddy Tschann wrote in a statement to CNN in 2020 that Walz “activated the Minnesota National Guard at the request of the Mayors of Minneapolis and St. Paul, before he talked to the White House.”

    Tschann told CNN that Walz was in touch with Trump administration officials during the unrest, including Defense Secretary Mark Esper and Joint Chiefs of Staff Chairman U.S. Army Gen. Mark Milley. But Walz was the one who put forward the plans for the use of the guard, he said.

    WCCO-TV wrote a timeline of Walz’s 2020 actions. 

    At 4:04 p.m. CST May 28 in Minnesota, Walz issued an executive order activating the Minnesota National Guard to allow for personnel and equipment to support emergency operations. 

    Walz wrote that “feelings of anguish, anger, and disillusionment are justified,” however, people engaged in “unlawful and dangerous activity” including arson, rioting and looting were threatening public safety.

    Following Walz’s order, Minnesota National Guard Maj. Gen. Jon Jensen said in a social media post at 4:13 p.m, “We are ready and prepared to answer the Governor’s request. We are currently in process of assigning and preparing units to respond.”

    At 10 p.m., Minneapolis police abandoned the department’s 3rd Precinct which was overtaken and burned.

    At 10:30 p.m., May 28, Trump watched the scene on television and called Walz, offering to send in the military, WCCO-TV wrote. 

    “We have activated more than 500 soldiers to St. Paul, Minneapolis and surrounding communities,” The Minnesota National Guard wrote at 10:41 p.m. May 28 in a social post. “Our mission is to protect life, preserve property and the right to peacefully demonstrate. A key objective is to ensure fire departments are able to respond to calls.”

    On May 29, Walz told reporters that he had spoken to Trump the night before. “At that point in time, it was in the process of where I said that we were going to assume control of this, that it was unnecessary,” he said. Trump, Walz said, had “pledged his support in terms of anything we need in terms of supplies to get to us.” 

    Trump tweeted near midnight May 29, 2020, that, “I can’t stand back & watch this happen to a great American City, Minneapolis. A total lack of leadership. Either the very weak Radical Left Mayor, Jacob Frey, get his act together and bring the City under control, or I will send in the National Guard & get the job done right …..”

    In another post that night, Trump wrote: “These THUGS are dishonoring the memory of George Floyd, and I won’t let that happen. Just spoke to Governor Tim Walz and told him that the Military is with him all the way. Any difficulty and we will assume control but, when the looting starts, the shooting starts. Thank you!” 

    When violence continued May 29 and May 30, 2020, Walz called up more troops and, on May 30, he activated the entire Minnesota National Guard. We don’t know whether Trump’s statements influenced Walz to call in more troops, although the governor’s office told CNN in 2020 that Trump had nothing to do with his decisions.

    Generally speaking, the president cannot order the U.S. military to perform law-enforcement activities domestically. But there are exceptions, primarily an 1807 law, the Insurrection Act, that allows states to request federal military assistance and allows the president, in limited circumstances, to deploy military personnel in the U.S. without a state’s consent. In general, the U.S. military cannot be used on U.S. soil. That’s been the case since the signing of the Posse Comitatus Act in 1878.

    RNC pointed to news articles showing that Walz hesitated to send in the National Guard

    We asked Trump spokespeople for evidence that Walz didn’t call in the National Guard. Republican National Committee spokesperson Anna Kelly pointed to criticism of the timing of Walz’s actions. Minnesota Republicans criticized the governor’s response. 

    The Star Tribune wrote in August 2020 that Minneapolis Mayor Jacob Frey, a Democrat, told reporters in an interview that Walz hesitated to send in the National Guard. Frey said he called Walz on the evening of May 27, 2020, asking him to send in the National Guard and Walz said he would consider it. The newspaper obtained texts and emails to verify that narrative.

    In his comments to the Star Tribune, Frey said that he asked whether his verbal requests constituted a formal request, and said that the governor’s staff confirmed that they did. But the Star Tribune wrote that the governor’s office disputed Frey’s portrayal of what had unfolded.

    At 10:55 a.m. May 28, 2020, Frey’s office made a written request for the National Guard, the Star Tribune wrote.

    Tschann told the Star Tribune that more information was needed to deploy soldiers and that Walz pushed Minneapolis city officials for details and a strategy. 

    The state Department of Public Safety contracted with Wilder Research, a St. Paul nonprofit, to review the state’s response. The 2022 review found that the timeliness of the guard’s activation was an area for improvement. It also called for improved communication and coordination with local jurisdictions regarding requests for the guard. The report criticized state and local offices’ actions and said the state and the city of Minneapolis had communicated poorly.

    The Republican National Committee also pointed to a May 30, 2020, article in The Washington Post that said Walz acknowledged the Trump administration’s offer for active-duty military. The U.S. military on May 29, 2020, had ordered several police units to be ready for potential deployment if Walz wanted federal assistance, according to a May 30, 2020, CNN report. By then, Walz had called up the Minnesota National Guard.

    Our ruling

    Trump said that during the 2020 Minnesota riots, Walz didn’t call in the National Guard. “So, I sent in the National Guard to save Minneapolis.”

    Minneapolis’ mayor, Frey, said Walz initially hesitated to deploy the National Guard on May 27, the day the Minneapolis first requested assistance. But Walz’s executive order shows he called up the National Guard on May 28, before Trump offered federal assistance.
