  • N.C. man accused of fatally hitting pedestrians with his truck after being kicked out of strip club

    TAMPA, Fla. (TCN) — A 25-year-old man faces multiple charges after allegedly running over multiple people, including one fatally, after being removed from a strip club “due to inappropriate behavior.”

    On Aug. 13 at around 4:19 a.m., Tampa Police officers responded to the parking lot of Emperors Gentleman Club, where a truck had crashed. Witnesses told police the driver, Dylan Fogle, had been kicked out of the club, and then he allegedly came back to “drive the truck into a group of people standing at the entrance.”

    Several people were near in the area at the time. Police said there were three victims, including Giovanni Soto, who was pronounced dead at the scene. The two other victims were transported to a local hospital for critical injuries but have been released.

    Officials also transported Fogle to a hospital for injuries. According to police, Fogle’s blood alcohol content was above the legal limit, and they believe alcohol contributed to the incident.

    Fogle faces charges of first-degree murder, two counts of attempted first-degree murder, vehicular homicide, two counts of DUI with serious bodily injury, and one count of DUI manslaughter. He remains held in the Hillsborough County Jail without bond. Records show Fogle is from North Carolina.

  • Fact Check: Buttigieg overstates Vance’s views on gay marriage

    In back-to-back interviews on CNN’s “State of the Union,” Republican vice presidential nominee J.D. Vance and Transportation Secretary Pete Buttigieg contradicted each other when asked about Vance’s views of gay marriage.

    During the Aug. 11 broadcast, host Dana Bash asked Vance his thoughts on Buttigieg’s family, which includes Buttigieg’s husband and adopted twins: “Do you recognize them as parents and, more broadly, as being part of families?”

    “Well, of course I do, Dana,” Vance said.

    Bash then invited Buttigieg on-air and asked him to respond to Vance’s statements.

    “When you asked him and pressed him on whether my family was legitimate, he said yes because I think he kind of felt shamed into it,” Buttigieg said. “Last time I checked, he doesn’t even think I should legally be able to have a family.”

    Buttigieg then said Vance holds “anti-marriage equality views.” 

    It’s been nearly a decade since the U.S. Supreme Court ruled that the Constitution guarantees the right to same-sex marriage. But LGBTQ+ advocates fear gay marriage’s future is not assured.

    However, saying Vance is “anti-marriage equality” doesn’t give a full picture. Vance opposed a 2022 federal law that recognized same-sex marriages. He has also voiced acceptance of gay marriage being legal, calling it “the law of the land” and saying he wasn’t doing anything to try to change that. 

    Harris campaign points to Vance’s 2022 statements on Respect for Marriage Act 

    The Transportation Department did not respond to our request for comment from Buttigieg, but, when asked for Buttigieg’s evidence, a spokesperson for Vice President Kamala Harris’ presidential campaign pointed us to 2022 campaign trail comments Vance made against the Respect for Marriage Act. 

    The act, signed into law in December 2022, requires all states recognize the legality of same-sex marriages — legislative protections that could hold should the 2015 Supreme Court precedent that legalized gay marriage be overturned. Congress took up the issue after  Supreme Court Justice Clarence Thomas called the 2015 ruling on gay marriage “demonstrably erroneous” and advocated it be revoked using the same rationale that the court used in revoking federally protected abortion access.

    During an Oct. 10, 2022, televised Senate race debate between Vance and Rep. Tim Ryan, D-Ohio, Vance said he opposed the Respect for Marriage Act, then pending before Congress. 

    “I don’t think it’s actually about gay marriage, it is not about same-sex marriage or same-sex equality,” Vance said. “Look, gay marriage is the law of the land in this country. And I’m not trying to do anything to change that.” He said he opposed the bill because he thought it would make it easier for the government and others to sue religious organizations that “don’t comply with the dictates of the federal government.”

    Vance’s team declined PolitiFact’s request for comment on Vance’s current same-sex marriage equality position. A 2022 Cleveland Plain Dealer story said that when asked about gay marriage, Vance, who is Catholic, had “pointed to the position of the Catholic church, which officially opposes it.”

    In his memoir, “Hillbilly Elegy,” Vance wrote about his exposure to antigay religious sentiment and described being friends with gay people. But he did not specifically weigh in on gay marriage.

    PolitiFact could not independently find any specific statements that Vance has made about the church’s position.

    Vance’s other comments on the Respect for Marriage Act

    Vance’s stance on the Respect for Marriage Act came up frequently during his Senate run.

    In July 2022, the Christian nonprofit Mission: America reported that Vance had said he would vote “no” on the bill, citing concerns about religious liberty. 

    In August 2022, in comments to reporters who asked him about the bill, Vance called it a “distraction.”

    “You have a sky-high inflation crisis, you have a huge recessionary problem, and we’re arguing about rights that have already been granted by the Supreme Court,” he said. “It seems like a bizarre distraction for a country that actually has much, much deeper and more serious crises.”

    The Respect for Marriage Act passed the House on Aug. 19, 2022, and was sent to the Senate, where religious liberty protections were added, earning the bill bipartisan support. Some conservative legal organizations, such as the Alliance Defending Freedom, still opposed the legislation finding the protections insufficient. 

    In his October debate with Ryan, Vance again said he continued to oppose the act.

    President Joe Biden signed the law Dec. 13, 2022, before Vance took office.  

    Vance’s recent comments on gay families

    As senator, Vance introduced proposals to restrict gender-affirming health care for youth and prohibit the use of the “X” gender designation, as opposed to “M” or “F,” on passports. Nonbinary people often use the “X.” Neither bill has made it out of committee.

    Since becoming the Republican vice presidential candidate, Vance’s political opponents have scrutinized Vance’s views on American families, and resurfaced statements he made in 2021, including to the Intercollegiate Studies Institute and then-Fox News host Tucker Carlson. In these interviews, Vance said people with children have more of a political stake in the nation’s future than those who do not and lamented that the U.S. was being run by “a bunch of childless cat ladies.”

    “The entire future of the Democrats is controlled by people without children,” Vance said on Carlson’s July 29, 2021, show, citing Buttigieg and Harris as examples. “How does it make any sense that we have turned our country over to people who don’t really have a direct stake in it. … Maybe if we want a healthy ruling class in this country, we should invest more, we should vote more, we should support more people who actually have kids, because those are the people who ultimately have a more direct stake in our future.”

    Vance has responded to the criticism by saying his comments were taken out of context.

    On Aug. 11, following the CNN segment, CBS News’ “Face the Nation” host Margaret Brennan asked Vance whether his proposal for a new childcare policy would include gay families. Vance said, “All families would be included, of course all families would be included.”  

    Trump and the Republican Party more broadly have quieted their opposition to gay marriage. 

    Before his presidency, Trump said in interviews that he supported “traditional marriage.” But, following the Supreme Court’s legalization, he described the issue as “settled.” The recently released 2024 Republican party platform also removed a 2016 condemnation of same-sex marriage legalization, but states an aim to “promote a Culture that values the Sanctity of Marriage, the blessings of childhood, the foundational role of families, and supports working parents.”

    Our ruling 

    Buttigieg claimed that Vance holds “anti-marriage equality views.”

    As he campaigned for his Ohio Senate seat in 2022, Vance said he would not support a bill that would federally legalize same-sex marriage. He cited concerns about religious liberty and described the bill as a “distraction,” given that the Supreme Court has already granted same-sex marriage rights.

    But Vance did say during a debate that “gay marriage is the law of the land in this country. And I’m not trying to do anything to change that.”

    Vance’s campaign did not clarify his current views on marriage equality. But comments in recent interviews signal that Vance recognizes families with gay parents. The Republican Party has removed from its 2024 platform its 2016 condemnation of same-sex marriage.

    The statement is partially accurate but omits important details or takes things out of context. We rate it Half True.

  • Conservation Groups Sue US Regulator Over SpaceX – The US Times

    The Federal Aviation Administration (FAA), which oversees the SpaceX Starship program, is being sued by several US conservation groups for failing to do enough to protect the planet. The lawsuit comes after the explosion of the world’s largest rocket on its first integrated flight, just four minutes after it launched from Boca Chica in Texas on April 20, 2019. According to the Center for Biological Diversity, which filed the lawsuit, the launch site is located next to a habitat that is vital for species such as the Kemp’s ridley turtle and the piping pluover bird. SpaceX received a five-year license to launch up to 20 Starships per year. Elon Musk was required to hire a biologist to monitor vegetation and wildlife, and to conduct a survey before and after the launch. Conservation groups say that these mitigation measures do not go far enough and are calling for an environmental review.

    The lawsuit also includes the Indigenous group Carrizo/Comecrudo, as Boca Chica Beach closures adversely impact their ability to conduct traditional ceremonies on their sacred land. According to the US Fish and Wildlife Service, the test flight ignited a fire that covered approximately 3.5 acres (1.55 hectares) of land in Boca Chica State Park south of the launchpad. The agency did add that no dead animals or birds have yet been discovered on refuge owned or managed land. The FAA is yet to make a comment about the lawsuit.

    In a recent statement, Jared Margolis – a senior lawyer at the CBD – said that it was vital to protect Earth’s life as we move into the modern age of spaceflight. “Federal officials must defend wildlife and communities in frontlines, not give corporate interests a free pass who want to dump space waste on coastal landscapes that are of great value.”

    Elon Musk, SpaceX’s founder and CEO, responded to the explosion by stating that the rocket prototype experienced an engine problem during landing. SpaceX has conducted a successful test of a new Starship prototype since then, but has not commented about the lawsuit.

    Peter’s back in Puerto Rico for this episode. He explains his theory behind the market’s bounce back last week, notes why last week’s panic bodes poorly for Bitcoin, and comments on two major political events— Kamala Harris’s VP pick and the “hate speech” clamp-down in the United Kingdom.

    With more evidence mounting of a recession, Peter reminds us that the Fed’s policy over the last few decades makes such a recession inevitable:

    The right thing is to raise rates more and let the chips fall where they may. Sure, stocks are going to crash. Real estate is going to crash. We’re going to have a hard landing. It’s going to be a recession. But unfortunately, that’s what we need. Not because it’s fun, but because it’s necessary. Now, if you don’t want to have this necessary crash, then the Fed never should have made that deal with the devil, because the devil is going to come to collect eventually.”

    Even though rate cuts are the wrong move, the markets are confident cuts are coming in September or even earlier:

    “I said on my podcast that if we didn’t get the emergency rate cut, we were getting a cut for sure in September. I just thought they may not even wait until September. They may have to do it sooner. And they still might because we still have a long time between that September meeting and right now. But because the bond market started to price that in and rates went down, that helped the markets, because the markets saw this and they’re like, ‘Ok, the Fed is definitely going to cut now.’ … The market now realizes that the Fed is going to move on in September no matter what. And that I think that helped the market’s psychology.”

    Bitcoin’s recent performance demonstrates why it’s a bad choice for a federal Bitcoin reserve:

    “When everything was going down, Bitcoin went down the most. And they’re trying to get the government to have a Bitcoin reserve? You can’t have a reserve asset that’s the most volatile asset. The reserve asset is the one you’re supposed to rely on. When everything else is selling off, you can use that reserve asset. But how can you use a reserve asset that goes down even more than the stuff you’re trying to hedge?”

    In election news, Kamala Harris has chosen Minnesota Governor Tim Walz as her running mate. Peter thinks Pennsylvania Governor Josh Shapiro would have been a better pick, but the media is keen to defend Harris against any criticism:

    “The media has been repackaging and rebranding her. I mean, they’re lying as much about Harris as they were about Biden. The same people had said, ‘Biden is sharp as a tack,’ right? And then kick him to the curb as soon as that lie was exposed. Now they’ve got a new lie about how great Kamala Harris is. As long as she keeps her mouth shut and nobody actually hears her talk, they can keep selling her to the American public like she’s the greatest thing. And apparently it’s working.”

    With the United Kingdom government cracking down on protests and online social media posts, Peter explains why free speech is so important:

    If you’re not allowed to be offensive, if you’re not allowed to hurt other people’s feelings, then you don’t have freedom of speech. Well, what do you have?

    The whole concept of free speech is that you have to defend the rights of people to say things that you disagree with— that may be offensive to you, that may be hateful. Because the minute you let the government decide, the government can decide, ‘what is offensive? What is hateful?’ Well, then they can make anything they want hateful or offensive.”

  • Man allegedly stabbed ex, kidnapped 3 kids, and led police on chase that killed infant daughter

    VIRGINIA BEACH, Va. (TCN) — A 36-year-old man is in custody after allegedly committing a crime spree that spanned two states, left his ex-wife hospitalized, and resulted in his young daughter’s death.

    According to the Virginia Beach Police Department, on Wednesday, Aug. 14, just before 8:50 p.m., the city’s Emergency Communications and Citizen Services got a call about a stabbing at a home on Jay Are Court. Police went to the residence and found an adult female and juvenile female both suffering from stab wounds. Paramedics took the victims to the hospital, where they are reportedly in stable condition. WAVY-TV reports the juvenile victim is the woman’s 12-year-old daughter.

    Police learned the suspect, Dana Plummer, reportedly kidnapped his 7-year-old son, 5-year-old son, and 1-year-old daughter after the stabbing incident. Virginia State Police issued an Amber Alert on behalf of the three children as Virginia Beach Police obtained warrants for Plummer’s arrest for two counts of malicious wounding, three counts of parental abduction, four counts of contributing to the delinquency of a minor, and domestic assault.

    Almost exactly 12 hours later, at 8:48 a.m. on Aug. 15, a passerby contacted law enforcement and said they believed they saw Plummer’s vehicle. Police attempted a traffic stop on the highway in Fairfax County, but Plummer did not pull over.

    Maryland State Police said they got a call from Virginia State Police just after 9 a.m. to alert them that Plummer was driving toward Maryland. According to Maryland State Police, Plummer was driving a Honda SUV and went across the Woodrow Wilson Bridge. He tried to get on an on-ramp when he crashed into several other cars, causing them to overturn. Maryland State Police Aviation Command airlifted the 16-month-old, identified as Za’Riyah Plummer, to Children’s National Hospital in Washington, D.C., where she died. The girl’s two brothers were driven by ambulance to the same hospital. Plummer was also taken to Capital Region Medical Center.

    Charges in Maryland are pending as state police work with the Prince George’s County State’s Attorney.

  • Fact Check: No, Candace Owens is not set to host an ABC talk show

    ABC’s daytime talk show, “The View,” is on a summer hiatus after wrapping its 27th season. But it will not be replaced by a talk show from controversial conservative commentator Candace Owens, who has faced repeated criticism for making antisemitic remarks. 

    “Candace Owens Signs $25 Million Deal With ABC For A Morning Show,” a Facebook post says. “It’s Going to Replace The View.” 

    The news originated on SpaceXMania, a satirical news site, which labeled the story as satire. The site describes itself as bringing “the freshest fake news, some sassy analysis, and a good dose of satire.”  

    “The View” posted on its official Instagram account that its 28th season will premiere in September. ABC has not made an announcement that Owens will be headlining a talk show. We also were unable to find any credible media reports supporting the claim. 

    An ABC spokesperson declined to comment on the claim. 

    We rate the claim that Candace Owens will host an ABC morning show that will replace “The View” False.

    Eva M. Walding, 78, of Madison, Alabama, lost her long battle with Parkinson’s Disease on August 14, 2024. Eva is survived by three sisters, Bobbie McVay, Sue Thorn, and Betty Bullard, niece Heather Sconyers, nephews Michael McVay, Brian McVay, and Devin Bullard, and many cousins and friends. Eva was preceded in death by her sister Rebecca Walding and parents Robert R. Walding and Della Mae Smith Walding.

    Eva was a very loving, gentle and loyal person who loved to laugh and dance but always put her family first. Throughout her life she was there for her mother and sisters emotionally, physically, and financially. She was also dedicated to her career.

    Eva, born August 6, 1946, grew up wanting to attend college but was unable to do so after she graduated from Opp High School in 1964. She never lost her desire to further her education and nine years after her high school graduation, in 1973, Eva entered the University of Alabama summer session as a freshman. She graduated in 1976 and immediately entered the University of Alabama School of Law. She took her JD in 1979 and a few months later passed the Alabama Bar Exam.

    She spent the majority of her career working for the US government first in the Bankruptcy Court in Montgomery, Alabama, and then in Opelousas, Louisiana. She moved to Oxford, Mississippi, in order to work for the FDIC, which moved her to Washington, D.C. From there she moved to Chicago, Illinois, and again worked for the Bankruptcy Court. During this time she was interviewed multiple times for judgeships. She decided to come back to Alabama and hung out her shingle for a time before going to work for the law firm Paden & Paden in Bessemer, Alabama. She then joined the prestigious Birmingham firm of Sirote & Permutt, PC. Finally, she worked for the Birmingham Office of Social Security Hearings and Appeals. While there, her health declined and she was granted a disability retirement.

    Eva was an avid reader from an early age and remained so all her life. Her mother would take Eva and her sisters to the Public Library once a week. The book check out limit was two books. Eva’s older sister, Bobbie, usually would only check out one book so Eva would beg her to check one out for her too. After this went on for a while, the librarian had noted that Eva took very good care of the books and always returned them on time. On one visit the librarian whispered to Eva, “You can check out as many books as you want,” making one little girl very happy. Her favorite author was Ken Follett and her favorite book was Follett’s Pillars of the Earth.

    Eva had many other passions too. She was a big Elvis Presley fan and saw him in concert five times. And yes, she got a scarf! Eva was also a fan of country singer Carl Smith. He was inducted into the Country Music Hall of Fame in 2003 during the CMA Awards and although tickets were not available to the public, Eva was there to congratulate him and give him a hug. Friends had networked and got her a ticket. While she wasn’t a big football fan, she did love the Crimson Tide and watched their games on TV,  jumping up and down when they scored and singing the fight song.

    Eva’s adventurous side led her to try whitewater rafting, community theater, swimming with dolphins, and feeding nectar to the birds causing them to land all over her. She also tried parasailing and exploring the cliff dwellings at Mesa Verde.

    Eva enjoyed square dancing with all her heart and soul and traveled around the country to Square Dance weekends. When her young niece said she wanted to square dance, Eva got to share her passion by organizing and teaching a children’s class. After their graduation, Eva went with them to adult club dances. She did so well the Alabama Square and Round Dance Association presented her with an Honorary Square Dance Caller certificate.

    Eva’s love of family especially showed up at Christmas. She always wanted to be the person who passed out the gifts. She called it “playing Santa” and there are many photos throughout the years of her wearing her Santa hat and handing out presents.  This is how we will most remember her, sharing joy with her family and giving of herself to everyone she met. We miss you Eva!

    Eva’s memorial service will be on Tuesday, August 20, 2024, at Wyatt Funeral Home in Opp, Alabama. Visitation will be at 1 p.m. with the service to follow at 2 p.m. Private burial will take place in Peaceful Acres Memorial Gardens in Opp.

  • Hollywood Writers Strike Looms With Deadline – The US Times

    Writers Guild of America has threatened strike action if major studios or networks do not agree to a new agreement by midnight on Tuesday. The key issues are writers’ compensation, and the profits generated from streaming. The WGA claims that salaries have stagnated or decreased in recent years and that it’s becoming difficult to make a living. Meanwhile, studios claim they are under economic pressures to cut costs. Another controversial issue is the formula used to calculate residuals on streaming shows. Writers receive only a fixed payout each year, even if they create a hit. In the past residuals for reruns on television or DVD sales were a percentage or a fixed fee.

    A strike could cause major delays in the release of television shows and movies planned for later this year or beyond. Hollywood writers stopped working for 100 days during the last strike, which cost the entertainment industry $2 billion. Both sides may reach a deal at the last minute or extend discussions temporarily, but picket line preparations have already started. Other Hollywood unions such as SAG-AFTRA, which represents actors, and DGA, which represents directors, have expressed solidarity with the writers and are currently holding their own negotiations with studios.

    WGA’s action is part of a broader trend in labor activism within the entertainment industry. Other unions are also calling for better wages, benefits, and job security. Workers say that the success of streaming led to an abundance of content, and record profits, for companies such as Disney and Netflix. However, they do not feel like these gains are being fairly shared. Studio executives claim they face economic pressures.
