  • ‘Affidavit Presented By Governor Ododo Not From Us,’ FCT High Court Tells Kogi Election Tribunal Document Is Fake

Members of the Social Democratic Party and supporters of its governorship candidate in the November 11, 2023 Kogi election, Murtala Yakubu Ajaka are currently in a jubilation mood.

This followed the testimony of the representative of the Federal Capital Territory (FCT) High Court at the Kogi Election Tribunal that Governor Usman Ahmed Ododo’s affidavit was fake and did not emanate from the court.

SaharaReporters had reported that Ajaka sued Ododo for certificate forgery as part of the electoral matter before the tribunal, which sought invalidation of his election.

The SDP candidate had avowed that the age declaration attached to Ododo’s document was forged, insisting that it was issued on a non-working day, Saturday, August 2, 2003.

SaharaReporters in 2023 published the document when a concerned citizen exposed the matter to the public for scrutiny.

However, at the resumed proceeding on Thursday, an FCT High Court witness appeared to confirm the status of the certificate.

The matter of election is currently ongoing simultaneously with that of certificate forgery.

The witness who gave his name as Danmusa Williams, was introduced by the counsel for the SDP led by Pius Akubo, SAN.

The witness told the court that he lives in Nyanya in the FCT, Abuja and is a civil servant working in the capital city.

He also told the court that he is the Commissioner for Oath.

When the counsel for the Petitioner, Akubo asked the witness: “Are you aware of the Subpoena to compel the witness to come to court?”

    He replied: “Yes, my Lord.”

Akubo: Do you have a copy of the subpoena?

    Witness: Yes.

The Petitioner’s counsel asked him to hand over the subpoena to the tribunal and it was shown to all the counsel for their examination. The Subpoena was subsequently admitted in evidence.

The Petitioner’s counsel continued his questions.

He asked, “Is it the same affidavit deposed by one Ahmed Usman Ododo attached to INEC form in the document before you?”

    Witness: Yes, my Lord.

The Counsel for the INEC, Kanu Agabi (SAN) during cross-examination asked the witness:

Question: You deposed in paragraph 7?

    Witness: Yes, my Lord.

Question: Did you confront the person alleged to have forged the affidavit?

Witness: There is no case of forgery before my court so I don’t need to confront the person rather it is the interested party that will bring the matter before the court but I reported to the court.

Question: Did you report to the police?

Witness: I don’t have the power to do so.

Question: Did you report to INEC?

    Witness: No, my Lord.

Question: Is there any indication in the affidavit you examine before coming to court that it’s forgery?

Witness: We examined and discovered that the date in the affidavit is on Sunday so I reported to the registrar of the court, my Lord.

Meanwhile, the Bimodal Voter Accreditation System (BVAS) machine has exposed some discrepancies in BVAS records which have been admitted as evidence in court. The reports are for the BVAS used for Okene, Okehi, Adavi and some parts of Ajaokuta and Lokoja.

  • Reps Probe Sale Of Gov’t Helicopters To Private Individuals

    Nigerian-College-of-Aviation-Technology-NCAT

The House of Representatives has vowed that it will recover two Bell Helicopters, Bell 206L4 BZB and Bell M2061- L4, belonging to the Nigerian College of Aviation Technology (NCAT), Zaria, sold to private individuals.

Rep. Ademorin Kuye, the Chairman, House of Reps Committee on Public Assets, said this at the investigative hearing on the sale of the two helicopters in Abuja on Thursday.

Kuye expressed concern over the sale of the two helicopters to private individuals, when the college was left with no helicopter for training.

The committee also questioned the process leading to the sale of the helicopters as security agencies, including Nigerian Air Force, Navy and the Police, indicated interest to purchase them.

The security agencies were, however, denied by the management of the NCAT.

The three security agencies, according to various submissions, did not only indicate interest to purchase the helicopters by writing but also visited the college but were denied the opportunity to purchase them.

Mr Shaka Imalighwe, Acting Rector, NCAT, said though he was the Deputy Rector of the college at the time the helicopters were sold, he was not part of the team/committee that facilitated the sales.

Imalighwe said that he took over the management of the college in an acting capacity in January 2024.

The Committee said in spite of initial appeals to NCAT to provide certain documents regarding the process that led to the sale of the helicopters in May 2023, they had not been able to provide it.

This, according to him, was in respect of approval of Federal Executive Council (FEC) and the Ministry of Aviation as well as newspaper publication advertising the intention to sell the helicopters.

Imalighwe told the committee that the helicopters were in service and being maintained by relevant aviation bodies when they were sold.

The acting Rector of the college also confirmed to the lawmakers that at the moment, there was no single helicopter in the institution for training.

The lawmakers argued that it was wrong for NCAT to have used an unlicensed auctioneer to sell the helicopters.

The committee directed the immediate past and current Minister of Aviation to appear before it in the next investigative hearing.

Also summoned was the Ministry of Works, Ministry of Finance Incorporated, MOFI, both immediate past and present Rectors of the College, among others.

Shettima, who gave the assurance at the official launch of the National Design and Innovation Competition at the Presidential Villa, Abuja, noted that Nigeria’s youthful population, with an average age of just 19 years old, “is an age group that is pregnant with ideas for innovation and for the social and economic transformation of Nigeria”, adding that, “Innovation drives manufacturing and Nigeria is brimming with possibilities and opportunities.”

  • Labour Party crisis deepens, as Board of Trustees takes over party

The Board of Trustees of the Labour Party says it has taken over the running of the affairs of the party, bringing a new dimension to the crisis rocking the opposition party.

The announcement follows the controversial convention of the party held at Nnewi, Anambra State on Wednesday during which Julius Abure was re-elected national chairman.

The BoT, in a statement issued late on Wednesday by its Chairman, Comrade S. O. Z. Ejiofor, said it did not recognise the national convention.

The statement reads: “Following the expiration of the tenure in office of the immediate past National Working Committee of the Labour Party headed by Mr. Julius Abure, the Board of Trustees of the Labour Party, in line with the Labour Party Constitution, has stepped in to steer the affairs of the Labour Party.

“This step is to avoid any leadership vacuum in the Labour Party.

“Furthermore, the Board of Trustees of the Labour Party, in consultation with major stakeholders in the Party, will soon communicate the processes for the conduct of an all-inclusive and expansive National Convention of the Labour Party.

“This is in line with the March 20, 2018, Federal High Court consent judgement delivered by Justice Gabriel Kolawole, which recognised the Nigeria Labour Congress (NLC) as the owner of the Labour Party and mandated that an all-inclusive and expansive National Convention of the Labour Party be held.

“The decision of the Board of Trustees is also in furtherance of the agreement signed between the former National Chairman of the Labour Party, Mr. Julius Abure, and the Nigeria Labour Congress (NLC) and the Trade Union Congress (TUC) on 27th June 2022, which was mediated by the Independent National Electoral Commission (INEC).

“While we commend members of the Labour Party, especially workers, students, youths, market women and men, Obidients, and candidates on the platform of the Labour Party for their contributions and fidelity to the ideals of the party, the Board of Trustees promises to quickly set in motion processes for the conduct of an all-inclusive and expansive National Convention.

“Unlike the charade that took place today in Nnewi and in tandem with the principles of popular democracy, the all-inclusive National Convention will start with grassroots congresses at ward, local government, state and ultimately at the national level.

“This process will not leave any genuine member of the Labour Party out and will be held in the full view of the Independent National Electoral Commission, media, civil society, security agents and the general public.

“We commend the leader of the Labour Party, Mr. Peter Obi and key stakeholders in the Labour Party for declining to deodorise the malfeasance that took place in Nnewi with their presence.

“The BOT assures all stakeholders that we are committed to reclaiming and repositioning the Labour Party as the vehicle for the socio-political emancipation of our dear country, her working people and populace.”

  • INEC Disowns LP’s Anambra Convention

    INEC-Chairman-Mahmood-Yakubu-

The Independent National Electoral Commission (INEC) has disowned Wednesday’s Labour Party (LP) National Convention in Anambra.

Mr Rotimi Oyekanmi, the Chief Press Secretary to INEC Chairman, said this when he spoke with the News Agency of Nigeria (NAN) in Abuja on Thursday.

Oyekanmi said that the conduct of the convention was not monitored by INEC, declining to state further why it was not monitored.

The LP had on Tuesday shifted the convention from Umuahia in Abia to Nnewi, Anambra State.

Speaking on the change in venue, Mr Kehinde Edun, the LP National Legal Adviser, told newsmen that the party had duly informed INEC about the change in venue and date.

“No, it is holding in Anambra. Nnewi to be precise, not Umuahia in Abia State again. In fact, Umuahia was not even the first venue we chose. Benin was the first choice before we changed to Umuahia and now Nnewi.

“So, we are at liberty to pick any venue of our choice. We only need to inform INEC about the change in venue and the time,” Edun said.

Section 82(1) of the Electoral Act, 2022 states that political parties shall give INEC at least 21 days’ notice of convention, congress, conference or meeting.

This includes the convention or meeting convened for the purpose of “merger” and electing members of its executive committees, other governing bodies or nominating candidates.
