  • Falana faults coroner’s judgement on Sylvester Oromoni, says he ignored evidence

Human rights lawyer, Femi Falana has faulted the ruling by the Coroner Inquest sitting in Ogba Magistrate Court examining the death of a 12-year-old student of Dowen College, Lekki, Sylvester Junior Oromoni.

According to Falana, the Coroner disregarded further toxicological examination and withdrew initial recommendations for criminal negligence charges, despite glaring evidence and allegations of bullying within the school, including the discovery of a mysterious substance in Sylvester’s stomach.

The Coroner Magistrate, Mikhail Kadiri, in his judgment, said Oromoni died as a result of failed treatment for his enlarged liver due to his parents and doctor’s negligence.

Kadiri said: “Based on the foregoing it is clear that the deceased health deteriorated in (doctor) PW 3’s care.

“PW 3, did not take proper care of the deceased, PW 3, completely abandoned the deceased for a period of more than 32 hours.

“The deceased’s death was an avoidable one but for the negligence of the parents and PW 3, they didn’t take him to the hospital until the day he died on November 30, 2021.

“The deceased went through an avoidable and excruciating pain and made to suffer needlessly,” Kadiri said.

Reacting to the judgement in a statement on Monday, Falana said the coroner ignored the evidence of the government pathologist that the “black substance” found in the stomach of the deceased was not subjected to toxicological examination.

“It is curious that the coroner ignored the evidence of the government pathologist that the “black substance” found in the stomach of the deceased was not subjected to toxicological examination. The allegation was that the deceased was forced to drink a poisonous substance.

“The Acting Director of Public Prosecution of Lagos State at the material time had recommended that some staff and students be prosecuted for criminal negligence over the bullying of students in the school. Four days later, the Acting DPP turned around to say that there was no case to answer without any fresh evidence from the police investigators. The coroner ruled that the acting DPP has the power to withdraw her recommendations at any time!

“The doctors who testified stated that the deceased died of sepsis and that the sepsis could have been caused by excessive massaging of the leg of the deceased. The coroner conveniently overlooked the fact that the school doctor and the nurses massaged the leg of the deceased for two days before inviting his parents to take him home.

“In an attempt to exonerate Dowen College, the coroner was silent on the overwhelming evidence of the bullying of the deceased, his sister, and other students by the same set of students. In particular, the coroner discountenanced the evidence of a student who had testified that he saw the deceased beaten up and subjected to torture by a group of senior students.

“In spite of such uncontradicted evidence, the coroner said that the deceased died of natural cause. The coroner claimed that the negligence of the family doctor led to the death of the deceased but failed to refer him to the Medical and Dental Council of Nigeria for appropriate sanctions,” said Falana.

EFCC Arraigns Father-in-Law, Daughter-in-Law for Alleged Forgery in Lagos

The Lagos Zonal Command of the Economic and Financial Crimes Commission, EFCC, on Monday, April 15, 2024, arraigned a father-in-law, Alaba Alakija and his daughter-in-law, Oyinkansola Alakija before Justice Mojisola Dada of the Special Offences Court sitting in Ikeja, Lagos on an amended two-count charge bordering on alleged conspiracy and using false documents.

One of the counts reads: “Alaba Alakija and Oyinkansola Alakija, on or about the 6th day of August, 2015 at Lagos, within the jurisdiction of this Honourable Court, with intent to financially benefit from the property located at No.10, Keffi Street, South-west, Ikoyi, Lagos, conspired amongst yourselves to use a false document titled: “Vesting Deed by Dr. Omodele Alakija and Mr. Afolabi Alakija”, the executors of the estate of the late Sir Ademola Alakija, purporting same to be made by Dr. Omodele Alakija and Mr. Afolabi Alakija.”

The defendants pleaded “not guilty” to the charges when they were to them.

In view of their pleas, prosecution counsel ,M. S. Owede prayed the court for a trial date and the remand of the defendants at a correctional facility.

Counsel to the first defendant, M.O. Akangbe, SAN, informed the court of the bail application of his client, which he said he had filed and served on the prosecution. While praying to move the application, he urged the court to grant bail to his client in the most liberal terms.

However, counsel to the second defendant, Victor Giwa, prayed the court to move the bail application of his client orally. He told the court that he was informed about the matter late and that he came from outside the jurisdiction of the court.

Giwa further stated that his client, whom he described as a lawyer, has a two month-old baby, whom she still breastfeeds, and that she would not jump bail. However, in a dramatic twist, the second defendant’s husband debunked the claim and told the court that their baby is nine months old.

After listening to both parties, Justice Dada granted bail to the first defendant in the sum of N10 million, with sureties in like sum, who must submit their international passports to the court.

The court, however, took possession of the passport of the second defendant.

Both defendants were released to their lawyers pending perfection of their bail conditions.

The judge adjourned the matter to May 28, 2024 for commencement of trial.

  • Over 20 Abducted Students Of Nigeria’s Federal University Gusau, Corps Members Regain Freedom In Zamfara After Over 200 Days In Terrorists’ Den

Some of the parents, who spoke on condition of anonymity, had earlier disclosed that several attempts they made to secure the release of their children failed.

A group of terrorists who abducted several students of the Federal University, Gusau in Zamfara State, who were abducted on September 22, 2023, finally released those remaining in captivity on Sunday.

A cousin of one of the female students confirmed this to SaharaReporters on Monday morning, adding that all the abducted students and staff members of the university had regained freedom.

“My sister was finally released together with other kidnapped students yesterday. All of them have been freed now. This is after spending 205 days in captivity,” the source told SaharaReporters.

“I don’t know if any ransom was paid actually,” the source added.

Bandits had invaded hostels in the Sabon-Gida community of the Bungudu Local Government Area of Zamfara, abducting over 20 students, mostly females.

It was also gathered that some members of the National Youth Service Corps (NYSC) who were abducted in Sokoto State were also released along with the students.

SaharaReporters had reported how the terrorists attacked three off-campus hostels at Sabon Gida, one of the university’s hosting communities on the outskirts of Gusau last year.

Some of the parents, who spoke on condition of anonymity, had earlier disclosed that several attempts they made to secure the release of their children failed.

They added that the bandits threatened that they would not release the female students numbering over 20, because of “the failure of the state government to negotiate with them as well as the corrupt practices of some officials in the government in the whole saga.”

All efforts to reach the state police command spokesperson, Yezid Abubakar for comments and updates were unsuccessful. He did not answer his calls and had yet to reply to messages sent to his mobile phone.

  • Alleged N4.8bn Fraud: Court Adjourns Cletus Ibeto’s Case till May 27

Alleged N4.8bn Fraud: Court Adjourns Cletus Ibeto’s Case till May 27

Alleged N4.8bn Fraud: Court Adjourns Cletus Ibeto’s Case till May 27

Justice Oyindamola Ogala of the Lagos State High Court sitting in Ikeja, Lagos, on Monday, April 15, 2024, adjourned the alleged N4.8 billion fraud brought against a businessman, Chief Cletus Ibeto, till May 27, 2024.
The matter, which was initially before Justice I.O. Ijelu, of the Lagos State High Court, Ikeja, suffered several adjournments due to the absence of the defendant to take his plea with respect to the 10-count charges raised against him by the Economic and Financial Crimes Commission, EFCC.

He was charged alongside his companies, Ibeto Energy Development Company and Odoh Holdings Ltd.

Ibeto had approached the appellate court , following the bench warrant issued against him by Justice Ijelu pending his arraignment. The defendant, through his lawyer, Chief Wole Olanipekun, SAN, had also approached the appellate court, challenging the jurisdiction of the High Court to hear the matter.

At the resumed sitting on Monday, defence counsel, Adebayo Oshodi, prayed the court to withdraw the application for stay of proceedings, pending the determination of the appeal and the one challenging the court’s jurisdiction filed by Onyechi Ikpeazu, SAN.

He also told court that he had filed a notice of preliminary objection, challenging the jurisdiction of the court, and prayed the court to allow him to move the application.

However, prosecution counsel, Rotimi Jacob, SAN, opposed the application on the grounds that the defendant had filed an appeal on the same issue before the Lagos Division of Court of Appeal. He also told the court that the appellate court had yet to decide on it.

He also informed the court that the defendant, in his bid for out-of-court settlement, had repaid the sum of N2 billion in installments to the Commission.

After listening to both parties, Justice Ogala ruled that hearing the defendant’s application would amount to nothing because the same issue “is currently pending before the appellate court.”

The Judge further held “There is nothing to sway me to hear it in a hurry. The defendant is not here. The court of appeal will sit on it. I will not waste time writing a ruling, while the case is still pending at the Appeal Court. If there was nothing in the Court of Appeal, I would have heard the application.”

Consequently, Justice Ogala adjourned the matter till May 27, 2024.

The Judge further directed the parties to notify the Court on the outcome of appeal, which has been fixed for May 7, 2024, at the appellate court.

  • Over 1000 Abductees Rescued Without Ransom —NSA Ribadu

The National Security Adviser, NSA, Nuhu Ribadu, says the Federal Government has rescued over 1,000 victims of verified mass abduction across the country without paying ransom.

Ribadu disclosed this on Monday, in Abuja while receiving 22 rescued students and staff of the Federal University Gusau, that the covert operations were conducted in the last few months.

He said the successful rescue operations were testimonies to the efforts of the government to free all those being unlawfully held in captivity.

“We have so far released over a thousand of such victims without noise and in complete respect for their privacy and safety.

“We released people from Zambara, Sokoto, Kaduna, Katsina, Taraba, Adamawa, and so many other states.

“Thousands, but never said a word and we thank God for that, and maybe that is the reason why we are so far very successful.

“This occasion marks a final juncture in a series of rescues we have undertaken in the last few months to free victims of recent cases of mass abductions that are verified.

“It is making a difference, it is a matter of time and we will see the outcome of the work we are doing,” he said.

The NSA said the victims were rescued unhurt and without any of the female abductees molested, adding that it was a marked departure from what had been the case in the past.

According to him, going forward, the government is strengthening law enforcement and security measures to prevent further abductions.

He added that the government would strengthen physical security across vulnerable communities in the country.

“This work is done by our security forces, our armed forces, our police, our intelligence agencies.

“All of us collectively have done this work together and we all are fully participating and this is the outcome of it,” he said.

Ribadu commended the leadership of President Bola Tinubu for working assiduously to address insecurity in the country.

According to him, the efforts have led to great improvement in recent times in taming terrorist attacks.

Recall that those rescued were abducted from the school on September 22, 2023, when bandits attacked three off-campus students’ hostels at Sabon Gida in Gusau.

Those kidnapped from the university included female students, some male artisans, a private security guard and a protocol officer.
