  • Former rock band member allegedly killed missing girlfriend and left remains in wooded area

CAPITOLA, Calif. (TCD) — Police arrested a 54-year-old man this week on suspicion of killing his 61-year-old missing girlfriend, whose remains were found in a wooded area.

According to the Capitola Police Department, Alice “Alyx” Herrmann was last seen on Dec. 3, 2023, in Santa Cruz. Police received a welfare check on Herrmann on Dec. 12 at around 2:20 p.m. after a family member said she had missed a flight to Hawaii. Officers searched Herrmann’s Capitola home but couldn’t find her and determined she was missing.

According to law enforcement, Herrmann’s car was parked outside the home of her boyfriend, Theobald Lengyel. Investigators determined Herrmann had been a victim of a homicide and identified her boyfriend as a person of interest.

Police said investigators found human remains in a wooded area in Tilden Regional Park in Berkeley. The Contra County Coroner’s Office will conduct an autopsy and positively identify the victim.

With the help of the Santa Cruz County District Attorney’s Office, El Cerrito Police Department, and the Department of Justice, police arrested Lengyel on suspicion of Herrmann’s death on Tuesday, Jan. 2. Lengyel was booked into the Santa Cruz County Jail without bail.

According to KRCR-TV, the suspect was a founding member of the Humboldt County band Mr. Bungle.

Prior to allegedly killing his girlfriend, another victim had filed a restraining order against Lengyel in 2017 following a domestic violence incident. The two eventually filed for divorce.

  • Ohio man indicted for allegedly fatally beating man and leaving his body in a toolbox

TROTWOOD, Ohio (TCD) — A 29-year-old man pleaded not guilty to killing a missing 62-year-old man and leaving his body in a toolbox near his home.

In December, the Montgomery County Prosecuting Attorney’s Office announced a grand jury returned an indictment against Nicholas Swisher for one count each of murder, felonious assault, kidnapping, tampering with evidence, and gross abuse of a corpse in connection with the death of John Mullins. Court records show Swisher entered the not guilty plea on Dec. 29.

Mullins was reported missing to Trotwood Police on Sept. 25, 2022, after he had not been seen for several days. Detectives located his body “stuffed inside a truck toolbox” behind the a home on Midway Avenue four days later. The autopsy showed Mullins died from multiple blunt force trauma injuries.

According to the affidavit cited by the Dayton Daily News, Swisher allegedly “lured” Mullins to his home, then “hit, kicked, and stomped” on him.

The affidavit says, “He then bound him with rope and duct tape before causing his death by beating. Nicholas then wrapped Mullins’ body, put him in a toolbox and disposed of him in the woods.”

Mullins was likely killed between Sept. 22 and Sept. 29, 2022.

Investigators later identified Swisher as the suspect and said he was arrested in Georgia on drug charges. He was later extradited back to Ohio.

The same day he got charged, Swisher was arrested for allegedly stealing a U-Haul truck and crashing with another driver during a police pursuit.

Swisher is in custody at the Montgomery County Jail with bond set at $1 million.

  • Nearly Half of Illegal Immigrants Arrested in U.S. in 2023 Had Multiple Criminal Charges, Convictions

As a result of the Biden administration’s reckless open border policies the federal agency charged with enforcing immigration laws inside the United States is getting slammed and discloses in its latest annual report that enforcement arrests nearly doubled in a year in which thousands of criminals were apprehended including dozens of known or suspected terrorists. In fiscal year 2023, which ended in September, Immigration and Customs Enforcement (ICE) arrested 170,590 illegal immigrants inside the country, almost half of them with criminal records. The criminal aliens had an average of four charges and convictions each, including more than 33,209 charges or convictions for assault, 7,520 for weapons offenses, 1,713 for homicide-related crimes and 1,615 for kidnapping. Removals also included 3,406 known or suspected gang members, 139 known or suspected terrorists, seven human rights violators, and 108 foreign fugitives wanted by their government for crimes including homicide, rape, terrorism, and kidnapping.

Among the most pervasive criminal offenses were Driving Under the Influence (DUI) and possession of serious drugs. Assault was also quite common among the undocumented perpetrators arrested last year and so were weapons offenses, sexual assault, and burglary. Thousands of the arrested migrants stole vehicles, were charged and/or convicted of fraudulent activities, robbery, forgery and property damage. More than 1,000 committed homicide and kidnapping and other types of threats not specified but considered serious enough by the government to be included in the year-end figures. “At-large arrests grew as broader migration trends contributed to an increase in unlawful entries to the Southwest border, driven by factors such as violence, food scarcity, severe poverty, unemployment, corruption, climate change, the ongoing impact of the COVID-19 pandemic, and dire economic conditions outside the United States,” the ICE report states.

The law enforcement agency with a staff of around 20,000 also conducted more than 200,000 domestic transfers of illegal immigrants last year and managed a record number of migrants under a controversial Biden administration catch-and-release policy known as Parole Plus Alternative to Detention (Parole+ATD) that freed over a million illegal aliens in the U.S. in a year, supposedly tracking them with technology and other tools. ICE Health Service Corps also spent a whopping $352 million to provide medical, dental, and mental health services for illegal immigrants detained in facilities throughout the nation, according to figures included in the document. “Those in ICE custody speak dozens of languages, including rare indigenous dialects, and the population includes individuals with a wide range of health statuses and unique physical and mental healthcare requirements — including some who receive comprehensive medical care for the first time after they are booked into detention,” the report says.

ICE’s Homeland Security Investigaions (HSI) division conducted an unprecedented number of investigations last year and executed 14,000 “noncitizen apprehensions,” seized an astounding 1.2 million pounds of narcotics, confiscated $5 million in assets and property, identified 1,806 victims of child exploitation, helped 731 victims of human trafficking, seized $949 million in criminally derived assets and more than $148 million in virtual currency from criminal elements. In cases involving drug cartels—officially known as Transnational Criminal Organizations (TCO)—that smuggle humans, narcotics, and money, HSI seized 69 firearms, 14,182 rounds of ammunition, 4,846 pounds of illicit drugs, and over $383,446 in currency. In one program alone, known as Operation Blue Lotus, HSI partnered with Customs and Border Protection (CBP), the frontline Homeland Security agency, to seize more than 8,200 pounds of fentanyl.

The distressing figures in the new ICE report are hardly surprising considering that 2023 was a record-breaker for illegal immigration with a ghastly 2.48 million foreigners entering the U.S. through the southern border, surpassing what was previously a historical high of 2.38 million in 2022. The last month of the fiscal year (September), federal agents encountered an unbelievable 269,735 illegal aliens constituting an all-time high for a single month and a substantial increase over August. The crisis is only worsening with time. This week a mainstream media outlet reports that there were 302,000 migrant encounters along the southwest border in December, marking the highest monthly total ever recorded.

  • Investigators identify homicide victim whose remains were found in Florida canal in 1985

WEST PALM BEACH, Fla. (TCD) — Officials recently identified a male homicide victim whose remains were found by juveniles playing in a heavily wooded area in the 1980s.

According to a news release from the Palm Beach County Sheriff’s Office, on Jan. 12, 1985, the children found the victim’s remains near a canal bank, and officials collected the remnants and searched the scene. The sheriff’s office and the Medical Examiner’s Office ruled the death a homicide.

Officials entered the victim’s DNA into the FBI’s CODIS database at the time, but investigators were unable to find a match. Officials called him “The Nameless.”

According to a Dec. 27 news release from Othram, the sheriff’s office submitted the victim’s skeletal remains to their labs in 2022, and they were able to build a comprehensive DNA profile using his remains and Forensic-Grade Genome Sequencing.

Othram scientists developed leads and sent the information to the sheriff’s office. The sheriff’s office then found a kinship match and positively identified the victim as Terry Ketron of Kentucky.

According to the sheriff’s office, Ketron had traveled from Kentucky to Florida with his “female companion named Connie or Bonnie” in the early 1980s. Ketron’s family had reportedly last heard from Ketron via phone, and he “shared information that he was having problems with his girlfriend and her family members.” His family hadn’t heard from Ketron since, and they didn’t know his location.

The case remains unsolved, but investigators are looking into Ketron’s death and working to identify the female companion with whom he traveled.

  • N.C. pastor allegedly tried to shove wife’s co-worker’s head into McDonald’s deep fryer

HIGH POINT, N.C. (TCD) — Police arrested a 57-year-old pastor last week after he allegedly assaulted his wife’s co-worker by trying to push his head into a deep fryer and punching him.

According to a High Point Police Department incident report, on Thursday, Dec. 28, Dwayne Waden’s wife was working as a manager in training at the McDonald’s on South Main Street when her co-workers allegedly started “disrespecting her.” She called Waden for help, and after he arrived, he reportedly confronted the victim.

The report alleges Waden “walked around the counter and placed his hands around the neck of the victim, pushing his head toward the deep fryer.”

Waden also purportedly punched the victim “several times on the face.” Other McDonald’s employees reportedly had to pull Waden back to separate him from the victim.

The report said the victim sustained a “large contusion to the forehead and right eye,” as well as scratches. EMS arrived at the scene, but the victim went to the hospital via private car.

Waden was arrested on a charge of misdemeanor simple assault.

  • Woman accused of beating man to death, covering body in plastic bags, and dumping remains in park

EXCELSIOR SPRINGS, Mo. (TCD) — Deputies are searching for a Kansas woman they allege beat a man to death, abandoned his corpse, and fled to Mexico.

According to the Clay County Sheriff’s Office, investigators believe 48-year-old Elena Del Carmen Flores killed the victim and left his body at Rocky Hollow Park, where his remains were found on Dec. 22. Court documents obtained by KCTV-TV allege deputies found the victim covered in black plastic bags, and he had sustained critical blunt force trauma injuries to his head and hand.

On the night of Dec. 20, Flores’ daughter reportedly heard a scream coming from Flores’ room. The suspect’s daughter allegedly saw her mother with a bat, and when she went into the room, she noticed the victim was unresponsive.

According to KCTV, Flores’ daughter told detectives she cleaned the room with acid and removed the carpeting and furniture per her mother’s orders. The suspect allegedly told her daughter to “lie about what she had seen” because her mother “may go to jail for a long time.”

The suspect reportedly made her daughter delete any phone call and text message records, and Flores said she was going to Mexico for a family emergency.

Officials tracked Flores’ black Volkswagen Jetta to a gas station in Kearney, Missouri. Investigators located surveillance video from the business that allegedly showed “shiny material consistent with what a black plastic trash bag looks like” in the back of Flores’ Jetta.

According to KCTV, authorities also recovered furniture and carpeting at different locations where the Jetta had been. Flores’ daughter told officials the furniture was from her mother’s room.

The 7th Judicial Circuit Court of Clay County filed a warrant for Flores’ arrest on charges of first-degree murder, armed criminal action, and abandonment of a corpse. Her bond has been set at $2 million.

According to the sheriff’s office, Flores goes by Elena Torres, Elena Flores Garcia, or Elena Stores. She is reportedly 5-foot-5 and weighs around 200 pounds.

  • Woman's car, remains found in retention pond near Disney World 12 years after she disappeared

ORLANDO, Fla. (TCD) — A nearly 12-year-old cold case reached a major turning point after a volunteer dive group discovered a missing woman’s car and remains on New Year’s Eve.

According to Sunshine State Sonar, Sandra Lemire left her grandmother’s home in Orlando on May 8, 2012, to go on a date with a man she met online. Lemire called her grandmother when she arrived in Kissimmee and said she would do the same when she left, but Lemire was never heard from again. Lemire was reportedly last seen leaving a Denny’s in Kissimmee driving a red Ford Freestar minivan.

Sunshine State Sonar, a dive group that works closely with law enforcement agencies, started looking for Lemire on July 2, 2022. They collaborated with the Orlando Police Department, and over the course of a year and a half, searched 63 different bodies of water. At the end of December, Orlando Police detectives reportedly shared new information with the team, which led them to map out different areas, including a “variety of highway locations.”

On Dec. 30, team members were searching the retention pond and got a hit on “what appeared to be a minivan submerged in 14 feet of water.” Divers went in, located the car, and said the license plate on the van in the pond matched the one Lemire was last seen driving.

The car and personal items were recovered and removed from the water the next day.

Mike Sullivan with Sunshine State Sonar told WESH-TV Lemire’s disappearance was “the case I was least optimistic about,” but that changed when Orlando Police provided the team with Lemire’s last cellphone ping location. He said he was “stressed out” and hyperventilating when they located the minivan.

Sullivan said he assumed Lemire’s disappearance was a result of foul play, but it “turned out to be just a bad, terrible car accident.”

Lemire’s son told WESH, “What he did was amazing. And without him and his team, none of this would have been possible. They didn’t ask for a dollar. That’s just the kindness of their heart.”

In a statement to WESH, Orlando Police said detectives are still waiting to positively identify the remains, but they confirmed the car was linked to Lemire’s disappearance.

CHICAGO (TCD) — Police have arrested a 44-year-old man on suspicion of fatally shooting his ex-girlfriend while she had an active order of protection against him.

According to the Chicago Police Department, Kenneth Brown allegedly fatally shot the 34-year-old victim in the 500 block of North Long Avenue on Dec. 13, 2023, at around 6:23 a.m. WLS-TV identified the woman as Brown’s ex-girlfriend, Maria Roque.

  • Man allegedly fatally shot his mother and killed a father of 7 during carjacking spree in Las Vegas

LAS VEGAS (TCD) — A 36-year-old man is dead after allegedly fatally shooting his mother, leading police on a lengthy car chase, and killing a father during a carjacking spree last week.

According to a news release from the Las Vegas Metropolitan Police Department, on Wednesday, Dec. 27, shortly after 3:40 a.m., officers responded to a report of a shooting in the area of Placid Street and Maulding Avenue. Justin Davidson allegedly fired shots at his family home and then headed to the wash area behind the residence.

Davidson’s parents reportedly woke up to the gunfire, went toward the wash area, and Davidson started shooting toward them. Davidson allegedly killed his mother as a result, and his father fled in his truck.

Upon officers’ arrival, police said Davidson began shooting toward them, and officers tried to seek cover. Davidson reportedly went up to a locked police vehicle, shot out the windows, entered the vehicle, and drove off.

A police pursuit ensued, but Davidson allegedly left the police car and went on to carjack multiple people in a truck at gunpoint and then drove to a gas station in the 8500 block of Blue Diamond Road. The truck occupants were unharmed.

At the gas station, Davidson allegedly tried to carjack someone in an SUV while they were pumping gas. Police said an officer went into the parking lot and observed Davidson aiming a gun at the citizen in the SUV. The officers reportedly discharged a gun, and Davidson fled in the SUV.

According to police, as the pursuit continued, Davidson reportedly went up to a van and shot at it. The van stopped. Davidson left the stolen SUV and fired another shot into the van before entering and pushing the victim out. At the scene, four officers discharged their firearms and shot at Davidson, hitting him numerous times, police said. Davidson drove away in the van and allegedly ran over the victim, later identified by KVUU-TV as 39-year-old Jerry Lopez.

According to police, officials pronounced the victim dead at the scene.

Davidson reportedly stopped near Durango Drive and Agate Avenue. He refused officers’ orders to exit the van, and SWAT and Crisis Negotiators responded to assist. Officials noticed there was no movement in the van, so police went in with medics and saw that Davidson was dead.

According to police, investigators recovered a “notebook with a diagram of a potential ambush situation indicating Davidson was prepared for an armed confrontation with law enforcement.” Investigators also found evidence in two homes associated with Davidson, including “tactical equipment, prepper supplies, numerous military manuals, and documents regarding police responses to mass casualty incidents.”

Lopez’s wife told KVUU that she and her husband had been married for 13 years and share seven kids. Six of the couple’s children had reportedly been adopted from foster care.

Lopez’s wife also said her husband worked as a driver for a medical company and was going to work at the time of the incident.

  • 10-year-old boy allegedly fatally shot another boy after he lost a bike race

SACRAMENTO, Calif. (TCD) — A 10-year-old boy and his father were arrested last week after the son allegedly shot and killed another boy his age using a stolen gun.

According to the Sacramento County Sheriff’s Office, on Saturday, Dec. 30, at 4:30 p.m., deputies were called to the 4700 block of Greenholme Drive regarding a shooting and found an unresponsive boy bleeding from his head and neck. Deputies administered first aid until medics arrived and transported the boy to a local hospital, where he died. Officials were initially told the victim was most likely 13 or 14 years old, but then they learned he was actually 10.

Witnesses reportedly told deputies the suspect or suspects went inside an apartment, so officials went to the residence and detained 53-year-old Arkete Davis and two juveniles.

The sheriff’s office said investigators learned the 10-year-old suspect went to his father’s car to get cigarettes for him and saw the gun inside. The boy allegedly “bragged that his father had a gun,” shot the 10-year-old victim once, and fled into his apartment. Detectives reportedly located the firearm in a trash can nearby and alleged Davis tried to get rid of it. The gun was stolen in 2017.

Davis, the suspect’s father, was reportedly not allowed to own a gun.

The 10-year-old suspect was arrested on a murder charge and booked into the Sacramento County Youth Detention Facility, while Davis was taken to county jail on firearm-related charges, child endangerment, and accessory after the fact.

KCRA-TV identified the victim as Keith “KJ” Frierson. He and the suspect were allegedly playing outside on their bikes when the shooting occurred. Frierson’s mother told KCRA the suspect lost a bike race and then shot her son.

According to KTXL-TV, Frierson’s mother said, “My baby took some groceries in the house, asked me if can he go outside to ride his bike. Not even 15 minutes later, my baby was gone.”

She added, “This happened for nothing. For nothing. Hold your babies. Hold them. We can’t even let our kids go ride bikes.”

Davis is due back in court Wednesday, Jan. 3.
