Daniel Penny was found not guilty on Monday after the Marine Corps veteran was charged with criminally negligent homicide in the death of Jordan Neely, a homeless man in New York City.
Penny put Neely in a chokehold last year after the erratic homeless man threatened to kill passengers on a subway train while high on drugs and experiencing a psychotic episode. At the time, Neely threatened that someone was going to “die today” and that he did not care if he went to prison for life.
The jury’s decision comes after the second-degree manslaughter charge against Penny was dismissed on Friday when jurors failed to reach a verdict.
